Many families in the Gulf, the UK, the US and elsewhere build their Thiruvananthapuram home while living abroad. It can be done well, but the risks are different: you cannot drop in to check a delivery, sign at the Village Office or stop a mistake before the concrete sets. This guide covers the legal and practical steps, in the order you will meet them.

Can an NRI build on land in Kerala?

Yes. Under RBI rules, Non-Resident Indians and Overseas Citizens of India may buy any immovable property in India other than agricultural land, a plantation or a farm house, and may inherit property of any kind. Building a house on land you already hold lawfully is an ordinary local payment; the rules do not require separate RBI permission for it, but confirm your own case with your bank or a lawyer.

The grey area is land classification. FEMA does not define 'agricultural land', while Kerala's records classify land as nilam (paddy) or purayidam (dry land). Before buying, have an advocate check the land's classification and paddy data bank status — our plot checks before building guide sets out what to look at.

Power of attorney: what to sign, and where

Most NRIs appoint a trusted relative to act for them in Kerala. A power of attorney signed outside India is recognised for registration under Section 33 of the Registration Act 1908 when executed before and authenticated by an Indian consul or another authority the section names. The Supreme Court held in July 2025 that these authentication rules are mandatory when an attorney presents a document for registration.

  • Prefer a special power of attorney that lists exactly what the holder may do — sign permit papers, deal with the Village Office, pay the contractor — rather than a general one. Lawyers commonly advise this to limit misuse.
  • Gulf countries are not part of the Hague Apostille Convention, so a PoA signed in the UAE, Saudi Arabia, Qatar or Oman is normally attested at the Indian embassy or consulate, in person with your passport.
  • In apostille countries such as the UK and the US, an apostilled document needs no further embassy attestation.
  • Once the PoA reaches Kerala it must be stamped within three months under the Kerala Stamp Act. A PoA for management carries a small fixed stamp duty, while one that gives a power to sell for consideration is charged as a percentage — confirm the current rate at the Sub-Registrar's office.

Getting the building permit on K-SMART

Building permits across Kerala — Thiruvananthapuram Corporation, the district's four municipalities and its grama panchayats — are applied for online on K-SMART. The Corporation and municipalities follow the Kerala Municipality Building Rules; the panchayats follow the Panchayat Building Rules. A registered engineer or architect prepares and files the drawings from their own login, and the owner approves the application.

  • Typical documents: the title deed, the current land tax receipt, a possession certificate from the Village Office, and the licensee's registration. Arrange the Village Office certificates through your PoA holder before you start design.
  • Under the October 2025 amendments, a house below 300 sq m built-up and no more than two storeys counts as low-risk and can use the self-certified route, with inspection at plinth level. Read our self-certified permit guide.
  • The rules do not spell out whether a PoA holder can be the permit applicant. Ask your local body before relying on it, and keep your own Indian mobile number and Aadhaar active for OTP approvals.

Paying for the build: NRE, NRO and TDS

Payments must come through banking channels — an inward remittance or a debit from your NRE, FCNR or NRO account. Money earned abroad usually sits in the NRE account, which is fully repatriable; an NRO account holds Indian income such as rent and can also pay local bills. A relative holding a PoA over your NRE account may make permissible local payments, such as paying the contractor, but cannot send money abroad. Keep the bank advice for every transfer.

Two tax points are worth raising with your chartered accountant. An individual paying a contractor more than ₹50 lakh in a financial year must deduct TDS at 2% — under the Income-tax Act 2025, in force from 1 April 2026. And ask every contractor whether quotes include GST; the rules for labour-only and full contracts differ, as our turnkey vs labour contract guide explains.

Running the build from abroad

Whatever the contract, the controls that protect a remote owner are the same. Most of them have to be agreed before work starts — they are hard to add once the site is running.

  • A written, itemised BOQ and specification against approved drawings, so there is nothing to decide by phone later.
  • Payments tied to completed, measurable stages — foundation, plinth, each slab, plastering — never large advances.
  • Dated photos and video at every stage, and before anything is covered up: reinforcement before each pour, conduits and pipes before plastering.
  • Every decision approved in writing against a drawing, not given verbally.
  • One accountable contact for the whole project — the main reason most NRIs choose turnkey design and build over a labour contract.
  • An independent engineer's check at key structural stages if you cannot be there yourself.

Timing the build around the monsoon and your visits

The south-west monsoon normally reaches Kerala around 1 June, and July is its wettest month. Thiruvananthapuram also gets a strong north-east monsoon in October and November — south Kerala is one of its heaviest areas. That matters for NRI families, because the Gulf summer holiday falls in the wettest weeks of the year, while a December visit comes at the start of the drier months.

Many families use the December trip for the things that need them in person — signing documents, meeting the engineer on site, fixing the plan — so that foundation and structural work can run through the dry months. Our monsoon-proofing guide covers detailing a house that will stand empty for long periods.

Trivandrum checks to make early

  • Airport height zoning — much of the city lies within 20 km of the airport.
  • Coastal zone (CRZ) — relevant near Kovalam, Vizhinjam, Varkala and the backwaters.
  • Master Plan 2040 zoning and road-widening lines, published by the Corporation.
  • How much house the plot can take — see building on a 5-cent plot.

When you build from abroad, the paperwork is your site visit. Write down the scope, the stages and the evidence you expect before the first payment.

Questions people ask

Can an NRI build a house in Trivandrum?

Yes. NRIs may own and build on residential land in India; the restriction is on agricultural land, plantations and farm houses. Have the land's classification checked first — see plot checks before building.

Do I need a power of attorney to build while living abroad?

Not by law, but in practice a special PoA lets a trusted relative handle Village Office documents and site matters. Sign it at the Indian embassy or consulate (or apostille it), and get it stamped within three months of it reaching Kerala.

Should I pay for construction from an NRE or NRO account?

Money earned abroad usually goes through the NRE account; NRO funds such as rent can also pay local bills. Keep the bank advice for every transfer, and ask your bank about repatriation if you may sell later.

How can I monitor construction from abroad?

Agree an itemised BOQ, stage-linked payments, dated photos before anything is covered, and written approvals before work starts. A single accountable firm under turnkey design and build makes this simpler.

When is the best time to start building in Trivandrum?

Plan so that foundations and slabs fall in the drier months, roughly December to May; Thiruvananthapuram gets rain from both monsoons, June to September and October to November. Discuss your timeline with us.
